Terms of Service

Welcome to PinVoyage. These Terms of Service ("Terms") govern your access to and use of the PinVoyage mobile application and related services (collectively, the "Service") operated by PinVoyage ("we," "our," or "us").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use PinVoyage. If you are under 18, you represent that you have your parent or guardian's consent to use the Service. By using PinVoyage, you represent and warrant that you meet these requirements.

2. Your Account

You are responsible for:

• Providing accurate and complete information when creating your account
• Maintaining the security of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

3. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Post or share content that is defamatory, obscene, hateful, threatening, or harassing
• Impersonate another person or entity
• Upload malicious software, viruses, or harmful code
• Stalk, harass, or harm another user, including misusing the Find My Friends feature
• Attempt to gain unauthorized access to the Service or other users' accounts
• Scrape, crawl, or use automated means to access the Service without our written permission
• Use the Service for any commercial purpose without our authorization
• Interfere with or disrupt the integrity or performance of the Service
• Share another user's location data without their consent

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines at our sole discretion.

4. Subscriptions and Billing

Free Tier

PinVoyage offers a free tier with core features. No payment is required to use the free tier.

Pro Subscription

PinVoyage Pro is available as a monthly or annual subscription that unlocks additional features including AI-powered logging, Find My Friends, expense splitting, and city guides.

Payment Processing

All subscription payments are processed through Apple (App Store) or Google (Google Play). By subscribing, you agree to the payment terms of the respective platform:

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
• Your Apple ID or Google account will be charged upon purchase confirmation
• Renewal charges are billed within 24 hours prior to the end of the current period at the same price
• You can manage and cancel subscriptions in your device's account settings

Refunds

Refund requests are handled by Apple or Google in accordance with their respective refund policies. We do not process refunds directly.

Price Changes

We may change subscription prices from time to time. Price changes will take effect at the start of the next billing period following notice. Your continued use of Pro features after a price change constitutes acceptance of the new price.

5. Content Ownership

Your Content

You retain ownership of all content you create or upload to PinVoyage, including pins, photos, trip logs, check-ins, and city guides ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute your User Content solely for the purpose of operating and improving the Service.

Our Content

The Service, including its design, features, code, branding, and documentation, is owned by PinVoyage and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

Shared Content

When you share a city guide or make content public, other users may view and interact with that content. You are responsible for ensuring you have the right to share any content you make public.

6. AI Features

PinVoyage uses artificial intelligence to power features such as trip logging, receipt scanning, and chat-based interaction. By using these features:

• You acknowledge that AI-generated content may contain errors or inaccuracies
• You agree that your inputs (chat messages, photos, receipts) will be processed by our AI provider (Anthropic)
• You understand that AI features require an active internet connection
• You are responsible for reviewing and verifying AI-generated trip logs and expense data

7. Privacy

Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect your personal information. By using the Service, you agree to our Privacy Policy.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results obtained from the Service (including AI features) will be accurate or reliable
• Any defects in the Service will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PINVOYAGE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless PinVoyage and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

11. Termination

You may stop using the Service and delete your account at any time through the app settings or by contacting us.

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account and User Content
• Provisions that by their nature should survive termination (including Limitation of Liability, Indemnification, and Dispute Resolution) will continue to apply

12. Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except that either party may seek injunctive relief in any court of competent jurisdiction. You agree to resolve disputes on an individual basis and waive any right to participate in a class action.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app or on our website and updating the "Effective Date" above. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PinVoyage regarding the Service and supersede all prior agreements.
